---|---|---|---|---|---|
Christine Kaiser-Reid | Z-3/20 | 2268 Lakeshore Drive | September 25, 2023 | October 4, 2023 | October 24, 2023 |
The applicant applied for these amendments and as per Section 34(18) of the Planning Act, R.S.O. 1990, c.P.13, as amended, Notice shall be given to any prescribed person or public body who has the right to appeal these by-laws. If you choose not to appeal these by-laws, no further action is necessary.
Purpose and Effect:
The Zoning By-law Amendment, as amended, will have the effect of amending the current Zoning Bylaw 2005.85 provisions of the Destination Commercial Exception Two (DC-2) to permit the addition of 24 new trailer sites, for a total of 46 year round trailer sites on the west side of Lakeshore Drive, in conformity with the provisions of Zoning Bylaw 2005.85.
All public comments received were considered in the decision rendered on this file. Concerns regarding the sewage system, impact to Lake Simcoe, occupancy and traffic were resolved through the studies and reports submitted by the applicant. Council denied the request for a reduction in the minimum exterior side yard setback from the currently permitted 6 metres to 4 metres.
At this time, there are no planning applications, under the Planning Act, pertaining to these lands.
Appeal process:
Only individuals, corporations or public bodies may appeal a decision of the municipality or planning board to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the zoning amendments were adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
